Mr. Clark graduated with honors from the University of Houston, and was a member of the Order of Barons (top 10%). He worked as law clerk at Fulbright & Jaworski in Houston while attending law school. After law school, he had a two year clerkship at the U.S. 5th Circuit Court of Appeals,  as a Staff Attorney in New Orleans. He entered private practice in 1980 doing business litigation and tort defense at the Seay Gwinn law firm in Dallas.  Mr. Clark became a partner at the Goins Underkofler law firm while continuing  to practice in business litigation and construction litigation, and representing business clients.  He left Goins Underkofler in 1994 to start his own small firm practice, and as a solo practitioner. One of founding partners of Kennedy Clark & Williams PC in 2010. Mr. Clark left McDole & Williams PC in 2013 to restart his solo practice as Clark Firm PLLC focusing on labor & employment law, while continuing to advise and form business entities, handling employment law issues, and reviewing and drafting company agreements and policies.  He is also active in handling federal Department of Labor (DOL) and state (TWC) audits/investigations of employers and small businesses, and defending related FLSA litigation. Mr. Clark is licensed to practice before U.S. Supreme Court, U.S. Court of Appeals, Fifth Circuit, Federal Circuit, and all federal and state courts in Texas.

Steven Clark has successfully represented clients throughout the State of Texas since 1980. Mr. Clark concentrates his practice on business formation, agreements and advice, business and commercial litigation, employment and labor law, general civil litigation and construction. He has assisted business clients in the review and drafting of agreements, and the acquisition and sale of assets. He also has represented franchisors and franchisees and handled franchise litigation. During his distinguished career, Mr. Clark has lectured and written on subjects such as choice of business entity considerations, trade secrets, non-competition agreements, partnerships, construction law, employment law, the Family and Medical Leave Act (FMLA), and the Fair Labor Standards Act (FLSA).

Mr. Clark has been recognized as a Texas Super Lawyer in Labor and Employment Law since 2011. He authored a book on Texas Employment Law Forms, and does an annual update for Texas Employment Law (James Publishing) on the Family Medical Leave Act.

He has testified on numerous occasions as an expert witness on reasonable attorneys’ fees and expenses.

Representative Client Matters

  • Products Liability/Negligence: Defense of Canadian armored vehicle manufacturer against claims of design defect and negligence arising out of a rollover accident that resulted in death of a passenger.
  • Business Litigation: Representing franchisee in lawsuit brought by an international restaurant chain after termination of the franchise agreement. Issues include alleged violations of the Lanham Act and 42 U.S.C. § 1981.
  • Business formation:  Recommends and forms business entities, and drafts related company agreements.
  • Employment and Labor: Represents companies in defense of overtime and minimum wage claims under Fair Labor Standards Act.
  • Construction: Advisory counsel for Italian construction company on issues relating to the Margaret Hunt Hill Bridge across the Trinity River Corridor in Dallas, Texas.
  • DOL & TWC Audits: Represent businesses undergoing audits by DOL or TWC & handle related unemployment and administrative cases
